This definition also includes individuals acting on behalf of a legal entity under actual or apparent authority.

   2. (b) The User will maintain the accuracy of such information.
   3. (c) The User is 18 years of age or older.
   4. (d) The use of the Site does not violate any applicable law or regulation.
   5. (e) A User's profile may be deleted, and their membership may be terminated without prior notice if the Site believes the User is in breach of any of these terms.
   6. (f) In no event shall the Site be liable for any damages, including, without limitation, indirect or consequential damages or any damages arising from the use or loss of use, data, or profits, whether in contract, negligence, or other tortious action, arising out of or in connection with the use of the Site.
6. Users agree to use this Site only for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. This includes, but is not limited to, conduct that is unlawful or may harass, distress, or inconvenience any person, as well as the transmission of obscene or offensive content or disruption of normal dialogue flow within the Site. If any User becomes aware of inappropriate content posted by another User, they are encouraged to report it by clicking on the "Feedback" link located at the footer of every page.

In the event of a conflict between provisions in this Agreement and terms applicable to a specific Paid Service, the conflict will be resolved in favor of RedBricksHomes.com and/or its affiliates unless otherwise expressly stated. If the conflict cannot be resolved, the specific terms of the Paid Service shall prevail.

Amendments:

RedBricksHomes.com reserves the right to amend this Agreement at any time by posting the updated version on the Site. The amended Agreement becomes effective immediately upon posting. Continued use of the Site constitutes acceptance of the amended terms. Modifications to this Agreement are not valid unless made in writing by an authorized officer of RedBricksHomes.com.

Membership Activation and Charges:

Membership is activated within two working days from the receipt of activation charges and remains valid for the period corresponding to the submitted charges. Web pages are created based on the information and approvals provided by the User and may take additional time. However, no relaxation will be granted for such delays.

3. If the User is subject to the Real Estate (Regulation and Development) Act (RERDA), they will ensure full compliance with all applicable requirements, including but not limited to obtaining necessary registrations.
4. The Site may require the User to provide supporting documents to verify claims related to the status of a property as specified by RedBricksHomes.com from time to time.
5. The User is responsible for setting up and configuring any equipment necessary to access the Service.
6. The User agrees to comply with any notices or instructions provided by the Company regarding the use of the Service.
7. The User assumes full responsibility for all information retrieved, stored, and transmitted through the Service.
8. The User is solely responsible for maintaining the confidentiality of their login credentials, including their username and password, and all activities performed through their RedBricksHomes.com account.
9. In the event of any unauthorized use of their account or any security breach, the User will promptly notify the Company.
10. The User agrees to pay the required Subscription Fees on time as specified by the Company.
11. The User will take all necessary actions, including regularly changing their password, to protect the security and confidentiality of their account. If the User wishes to discontinue their association with RedBricksHomes.com, they can unsubscribe or remove their account by completing the delisting procedure using the “Remove Account” link available in their folder.

Intellectual Property Rights of RedBricksHomes.com

6. The User will not use the Service to send or receive any messages that are offensive on moral, religious, racial, or political grounds, or messages that are vulgar, obscene, malicious, or menacing in nature.
7. The User is prohibited from repeatedly sending messages or making posts on RedBricksHomes.com to any other User or third party without reasonable cause, or in a way that causes harassment, annoyance, irritation, or anxiety.
8. The User may not introduce, upload, post, distribute, publish, or transmit any content or software that:
   • Contains a virus, worm, or any other harmful component that could damage the Internet or RedBricksHomes.com network systems.
   • Breaches the intellectual property rights of any individual or entity or retains such information with the intent to infringe on those rights.
   • Is unlawful or could be perceived as abusive, defamatory, libelous, harmful, threatening, harassing, vulgar, obscene, or objectionable in any way (racially, ethnically, or otherwise).
   • Is intended to mislead or deceive other Users.
   • Infringes any trademark, patent, or copyright.
9. RedBricksHomes.com does not permit registration or transactions by any member or user with direct or indirect involvement in any sanctioned countries or territories (Cuba, Iran, Syria, North Korea/Democratic People's Republic of Korea, Crimea, and Sevastopol/Crimean Autonomous Republic), as per sanctions laws imposed by the UN, US, UK, EU, or any other governing or regulatory authority.
10. In the event of a violation of any of the above terms, and if such a violation comes to the Company's attention, the Company reserves the right to delete any material related to the violation without prior notice. The Company will issue a warning to the User to cease any activity that leads to the violation. If the User continues such activity, the Company has the sole authority to terminate or suspend the User’s membership at RedBricksHomes.com and/or any related services. Additionally, the Company reserves the right to pursue legal remedies and seek indemnity to recover any losses or damages caused by the User’s violation, including harm to the Company’s reputation or goodwill.

Copyright Policy

Users may not post, distribute, or reproduce copyrighted material, trademarks, or other proprietary information without obtaining prior written consent from the owner of such rights. Refund Property Leads

Requests for a refund of property leads due to non-contactable contact details must be made within 5 days of purchase. If the request is not made within this period, it will not be entertained. Refund requests related to canceled or fulfilled leads will not be accepted, as the platform does not monitor deal finalization, transactions, or user preferences.

The refund request can be for a maximum of 25% of the assigned property lead quota. Refunds can be processed directly via the member folder; however, the refund option will become inaccessible once this limit is exceeded, regardless of the reason for the refund request.

Website Designing Services

Website design services are offered as part of certain paid services, and the site retains sole responsibility for the technical maintenance of the website. Users agree to indemnify RedBricksHomes.com and its affiliates, officers, and employees from any losses, claims, or liabilities (including legal costs) resulting from third-party interruptions or technical errors related to website uploads or hosting.

As part of a paid service, the website design service is provided with centralized database-driven templates. The site retains exclusive rights to technical details, including FTP access, and no claims will be entertained regarding these elements. Attempts to transfer the website to another server will render it non-functional.

Users agree to fully cooperate with the information gathering required for the website development process. If users fail to respond to calls, emails, or provide necessary details, feedback, or approvals, the website design service will be terminated after two reminder emails. Additionally, the Company does not warrant that Redbrickshomes.com or its linked websites will be free of operational errors or harmful components such as viruses.

Users are responsible for checking the authenticity of responses, inquiries, or information they receive from the platform. The site is a public platform, and the Company does not monitor the quality or genuineness of responses.

The data provided by Users can only be updated by the User, who holds responsibility for ensuring its accuracy. The Company is not liable for the accuracy of any updated information.

Users must comply with all applicable local laws and international conventions when using the site. The platform is controlled and operated from India, and the Company does not make any representations regarding the availability or appropriateness of materials for use outside of India.

Users are advised to independently verify the authenticity of any pre-launch offers and ensure background checks on property builders and projects before making any investments. The Company assumes no liability for the quality or genuineness of any projects displayed on the site.

Use of Data

By agreeing to this agreement, the User authorizes the Company to use any data and information provided in connection with this agreement for its own purposes, including sharing the data with associated companies or selected third parties, such as search engines. All data and information provided by the User will remain in the Company's property, records, and databases for the duration of the service agreement, even if the service is terminated or suspended. If the User wishes to delete their data after termination, they must notify the Company.

Grievance Redressal

RERA Disclaimer

Sellers, including Project Developers, Builders, and Real Estate Agents, must obtain necessary registration under the RERA Act of 2019 and comply with its rules and regulations. The Company does not guarantee or offer any warranties regarding the accuracy of RERA credentials or compliance by the sellers. Users are advised to refer to the relevant RERA websites of the respective State for complete procedures and accurate information. The Company is not liable for any damages due to discrepancies or inaccuracies in the information posted.

Indemnity

The User agrees to indemnify and hold Redbrickshomes.com, its subsidiaries, affiliates, officers, agents, and employees harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, arising from the User's violation of this agreement or breach of these terms.

Variation

The Company reserves the right to amend the terms and conditions at any time and will notify Users of such amendments. Updated terms will be posted on Redbrickshomes.com, and continued use of the site after updates constitutes acceptance of the revised terms.

User Disputes

Users are responsible for their interactions on Redbrickshomes.com. While the Company may monitor disputes, it is not obligated to do so. Redbrickshomes.com will not be a party to any legal proceedings between Users, but will cooperate with legal authorities as required, with associated costs to be borne by the party that implicated the Company.

Matter of Disputes and Jurisdictional Aspects
